Text

The commissioner may deny an application for an original permit for the construction or operation of a landfill if the commissioner finds that:

(1)the applicant does not have a positive net worth of at least two hundred fifty thousand dollars ($250,000); or
(2)there is at least one (1) unsatisfied and nonappealable judgment requiring the payment of money by the applicant. [Pre-1996 Recodification Citation: 13-7-22-2(g).]
