Text

The commissioner may proceed in the appropriate court to recover costs and damages from a person who:

(1)is responsible for the improper storage of waste tires; and
(2)fails, without sufficient cause, to properly undertake a removal or remedial action under section 13 of this chapter. [Pre-1996 Recodification Citation: 13-7-23-18 part.]
