Text

The active area of a composting facility may be located less than two hundred (200) feet from a residence if:

(1)no unit of local government with jurisdiction over:
(A)the residence; or
(B)the composting facility; has adopted an ordinance under section 5 of this chapter or IC 13-7-35-6(b) (before its repeal); and
(2)the composting facility obtains written consent from the occupant and the owner of the residence. [Pre-1996 Recodification Citation: 13-7-35-6(c).]
