A department enforcement action must commence by issuing a notice of violation under IC 13-30-3-3 not more than three (3) years after the date the department discovers:

(1)the event; or
(2)the last of a series of events; that serves as the basis of the department's authority to conduct the enforcement action. [Pre-1996 Recodification Citation: 13-7-5.5-3.]
