§ 7512 — Violations and penalties

Whoever violates this chapter or any order or quarantine regulation issued hereunder, or interferes in any way with the duly-appointed representatives of the Department of Agriculture in the discharge of the duties specified in this chapter shall be subject to the assessment of a civil penalty of no less than $100 and no more than $1,000 on each count. For purposes of §§ 7505, 7509, 7510 and 7513 of this title, each colony shall constitute a single offense or count. For § 7504(b) of this title no penalty should be assessed. No civil penalty shall be imposed until an administrative hearing is held before the Secretary of Agriculture or the Secretary’s designee. No civil penalty shall be assessed unless the person charged shall have been given notice and an opportunity for a hearing on such
