§ 1102 — Definitions

As used in this chapter:

(1)“CMS” means the Centers for Medicare and Medicaid Services of the United States Department of Health and Human Services.
(2)“Controlling person” means: a. A person who has the ability, acting alone or in concert with others, to directly or indirectly influence, direct, or cause the direction of the management, expenditure of money, or policies of a facility or other person. b. For purposes of this chapter, “controlling person” includes the following: 1. A management company, landlord, or other business entity that operates or contracts with others for the operation of a facility. 2.
