§ 43-4-809 — Enterprises - applicability of other laws

(1) Notwithstanding any
law to the contrary, neither the bridge enterprise nor the transportation enterprise
shall be subject to the provisions of the Procurement Code, articles 101 to 112 of
title 24, C.R.S.

(2) (a) The bridge enterprise and the transportation enterprise shall be
subject to the open meetings provisions of the Colorado sunshine law contained in
part 4 of article 6 of title 24, C.R.S., and the Colorado Open Records Act, article
72 of title 24, C.R.S.

(b) For purposes of part 2 of the Colorado Open Records Act, article 72 of
title 24, C.R.S., the records of the bridge enterprise and the transportation
enterprise shall be public records, as defined in section 24-72-202 (6), C.R.S.,
regardless of whether the bridge enterprise or the transportation enterprise
receives less than ten percent of its total annual revenues in grants, as defined in
section 24-77-102 (7), C.R.S., from all Colorado state and local governments
combined.

(3) Revenues of the bridge enterprise and the transportation enterprise shall
not be subject to the provisions of section 43-1-1205.

(4) The bridge enterprise and the transportation enterprise shall each
constitute a public entity for purposes of part 2 of article 57 of title 11, C.R.S.

(5) Labor standards specified in law that apply to the department shall apply
with equal force to the bridge enterprise and the transportation enterprise.
