Text
At its discretion, the department may award a
stipulated fee to the design-build firms that submit responsive proposals but that
are not awarded the design-build contract for a transportation project. The
department shall not be required to award such stipulated fee, but if it elects to
award such fee for a transportation project, the department shall identify the
availability and the amount of such fee in its request for proposals.
