§ 32-1-106 — Repetitioning of elections - time limits

(1) If, after any election
for the organization or dissolution of any special district or for the inclusion of
territory into a special district pursuant to section 32-1-401 (2) or for the exclusion
of property within a municipality from a special district pursuant to section 32-1-502, it appears that the proposal was defeated, no new petition for the organization
or dissolution, as the case may be, of such a special district embracing the same or
substantially the same area and no new petition for inclusion or exclusion, as the
case may be, of territory pursuant to sections 32-1-401 (2) and 32-1-502 shall be
submitted again until the expiration of eight months after the date of the election
at which the proposal was defeated.

(2) If, after any election submitting to the electors of any special district the
proposition of creating any indebtedness of the special district, it appears that the
proposition was defeated, no new proposition for creating such indebtedness of the
special district shall be submitted until the expiration of five months after the date
of the election at which the proposal was defeated.
