As used in this part 1, unless the context otherwise requires:
(1)Approved site or facility means a site or facility for which a certificate of
designation has been obtained, as provided in this part 1.
(1.5) Closed site or facility means a site or facility that has been closed in
accordance with provisions of the federal regulations pursuant to subtitle D of the
federal Resource Conservation and Recovery Act of 1976, as amended, as
published in 40 CFR 258.60, and in the manner specified in the approved certificate
of designation application at the time of approval of the site or facility or in a
closure plan that has been approved by the department.
(2)Department means the department of public health and environment.
