Text
(1)The commission may
adopt the following water quality designations:
(a)Outstanding waters;
(b)Use-protected waters.
(2)The commission shall promulgate criteria governing the designations
provided in subsection (1) of this section. Such criteria shall be consistent with the
provisions of this section and sections 25-8-102 and 25-8-104.
(3)Outstanding waters.
(a)Outstanding waters shall be maintained and
protected at their existing quality. Segments shall not be designated as
outstanding waters unless the commission determines that:
(I)The quality of the waters is better than necessary to support propagation
of fish, shellfish, and wildlife and recreation in and on the water based upon water
quality standards for indicator parameters identified by the commission in the
