Text
(1)(a) The fees required pursuant to this part 5 shall be
established pursuant to rules and regulations promulgated by the commission.
(b)The commission shall adjust the fees so that the revenue generated from
such fees is sufficient to cover the division's direct and indirect costs in
implementing the provisions of this part 5.
(2)All fees collected by the division pursuant to this part 5 shall be
transmitted to the state treasurer, who shall credit the same to the stationary
sources control fund established pursuant to section 25-7-114.7 (2)(b). The general
assembly shall appropriate to the department of public health and environment, at
least annually, from the fund, an amount sufficient to implement the provisions of
this part 5.
