Text
(1)The requirements of the state implementation
plan for prevention of significant deterioration of ambient air quality shall not apply
to a major stationary source or major modification with respect to a particular
pollutant if the owner or operator demonstrates that:
(a)As to the pollutant, the source or modification is subject to part 3 of this
article, and the source or modification would impact no area attaining the national
ambient air quality standards (either internal or external to areas designated as
nonattainment under section 107 of the federal act); or
(b)(Deleted by amendment, L. 92, p. 1229, � 27, effective July 1, 1992.)
(c)Such emissions would be from a temporary activity which will not have an
adverse impact on air quality in any class I area or an area wher
