§ 25-4-1302 — Definitions
As used in this part 13, unless the context otherwise requires:
(1)Bulk foods means unpackaged or unwrapped foods, either processed or
unprocessed, in aggregate containers from which quantities desired by the
consumer are withdrawn. Bulk foods does not include fresh fruits, fresh
vegetables, nuts in the shell, salad bars, bulk pet foods, potentially hazardous
foods, and bulk nonfood items.
(2)Department means the department of public health and environment.
(3)Display area means a location, including physical facilities and
equipment, where bulk foods are offered for customer self-service.
(4)Potentially hazardous foods includes any food that consists in whole or
in part of milk or milk products, eggs, meat, poultry, fish, shellfish, edible crustacea,
or other food products
