(1)As of July 1, 2022, the department of public health and environment shall execute,
administer, perform, and enforce the rights, powers, duties, functions, and
obligations of the community prevention and early intervention programs
authorized pursuant to sections 27-80-103 (2)(d), 27-80-106, 27-80-117, and 27-80-124 previously administered by the department of human services.
(2)(a) As of July 1, 2022, all employees of the department of human services
whose duties and functions concerned the duties and functions assumed by the
department of public health and environment pursuant to this section, and whose
employment in the department of public health and environment is deemed
necessary to carry out the purposes of the community prevention and early
intervention programs for

As of July 1, 2022, the department of public health and environment shall execute,
administer, perform, and enforce the rights, powers, duties, functions, and
obligations of the community prevention and early intervention programs
authorized pursuant to sections 27-80-103 (2)(d), 27-80-106, 27-80-117, and 27-80-124 previously administered by the department of human services.
(2) (a) As of July 1, 2022, all employees of the department of human services
whose duties and functions concerned the duties and functions assumed by the
department of public health and environment pursuant to this section, and whose
employment in the department of public health and environment is deemed
necessary to carry out the purposes of the community prevention and early
intervention programs for the department, are transferred to the department of
public health and environment and become employees of the department of public
health and environment.
(b) Any employees transferred to the department of public health and
environment pursuant to this section who are classified employees in the state
personnel system retain all rights to the personnel system and retirement benefits
pursuant to the laws of this state, and their service is deemed to have been
continuous. All transfers and any abolishment of positions in the state personnel
system must be made and processed in accordance with state personnel system
laws and rules.
(3) As of July 1, 2022, all items of property, real and personal, including office
furniture and fixtures, books, documents, and records of the department of human
services pertaining to the duties and functions transferred pursuant to this section,
are transferred to the department of public health and environment and shall
become the property of the department of public health and environment.
(4) As of July 1, 2022, whenever the department of human services or
department is referred to or designated by any contract or other document in
connection with the duties and functions transferred to the department of public
health and environment, such reference or designation is deemed to apply to the
department of public health and environment. All contracts entered into by the
departments prior to July 1, 2022, in connection with the duties and functions
transferred to the department of public health and environment are hereby
validated, with the department of public health and environment succeeding to all
rights and obligations under such contracts. As of July 1, 2022, any cash funds,
custodial funds, trusts, grants, and appropriations of funds from prior state fiscal
years open to satisfy obligations incurred under such contracts are transferred and
appropriated to the department of public health and environment for the payment
of such obligations.
(5) On and after July 1, 2022, unless otherwise specified, whenever any
provision of law refers to the department of human services in connection with the
duties and functions transferred to the department of public health and
environment, such law must be construed as referring to the department of public
health and environment.
(6) As of July 1, 2022, all rules and orders of the department of human
services adopted in connection with the powers, duties, and functions transferred
to the department of public health and environment shall continue to be effective
until revised, amended, repealed, or nullified pursuant to law.
