Text
(1)There is created in the
state treasury the pollution prevention fund. Any money collected pursuant to
section 25-16.5-107 is credited to the fund. All interest derived from the deposit and
investment of money in the fund is credited to the general fund. At the end of any
fiscal year, all unexpended and unencumbered money in the fund remains in the
fund and is not credited or transferred to the general fund or any other fund.
(2)The money generated from the pollution prevention fees pursuant to
section 25-16.5-107 is annually appropriated to the department to cover the direct
and indirect costs for sustainability services set forth in section 25-16.5-106. The
money in the fund shall not be used for the enforcement of any state law or
regulation governing environmental protect
