As used in this article 74.1, unless the context otherwise requires:

(1)Employee means a person in the service of a public child care center, public school, local education provider, public institution of higher education, public health-care facility, or publicly supported library while acting in the person's employment capacity. Employee includes an officer or employee, whether elected or appointed and whether full-time, part-time, or temporary.
