§ 24-32-702 — Legislative declaration

(1) It is hereby declared that there
exists in this state a need for additional adequate, safe, sanitary, and energy-efficient new and rehabilitated dwelling units; that a need exists for assistance to
families in securing new or rehabilitated rental housing; and that, unless the supply
of housing units is increased, a large number of residents of this state will be
compelled to live under unsanitary, overcrowded, and unsafe conditions to the
detriment of their health, welfare, and well-being and to that of the communities of
which they are a part. It is further declared that coordination and cooperation
among private enterprise and state and local government are essential to the
provision of adequate housing, and to that end it is desirable to create a division of
housing within the department of local affairs. The general assembly further
declares that the enactment of these provisions as set forth in this part 7 are for the
public and statewide interest.

(2) The general assembly further finds that, in an effort to meet the housing
needs within the state, the private housing and construction industry has developed
mass production techniques which can substantially reduce housing construction
costs and that the mass production of housing, consisting primarily of factory
manufacture of dwelling units, presents unique problems with respect to the
establishment of uniform health and safety standards and inspection procedures.
The general assembly further finds that by minimizing the problems of standards
and inspection procedures it is demonstrating its intention to encourage the
reduction of housing construction costs and to make housing and home ownership
more feasible for all residents of the state.

(3) The general assembly further finds that, in an effort to meet the housing
needs within the state through the use of manufactured housing units, it is
necessary to require state supervision of compliance with government-approved
codes of manufacture, such as the uniform building code and the federal
regulations governing manufactured housing units. It is the intent of the general
assembly that such supervision be accomplished primarily through the use of
private inspection and certification entities to the extent allowed by the state
constitution, the State Personnel System Act, article 50 of this title, and the rules
promulgated by the state personnel board.

(4) The general assembly further finds and declares that:

(a) Publicly-assisted rental housing that is affordable to low- and moderate-income persons should be preserved; and

(b) The division of housing should encourage property owners to notify the
division when affordable housing units will be lost as housing for low- or moderate-income persons, so that the division may explore options for preserving the
affordable housing resources.
