Text
If any governmental body
purchases any supplies, services, or construction contrary to the provisions of this
code or the rules promulgated pursuant thereto, the head of such governmental
body and the public employee, which for the purposes of this section includes
elected officials, actually making such purchase shall be personally liable for the
costs of such supplies, services, or construction. If such supplies, services, or
construction are unlawfully purchased and paid for with state moneys, the amount
thereof may be recovered in the name of the state in an appropriate civil action.
