(1)Subject to the provisions of subsection
(2)of this section, a creditor may contract for the payment by the consumer of a
prepaid finance charge; except that the total finance charge contracted for and
received by the creditor shall not exceed that permitted for consumer credit
transactions.
(2)With respect to a refinancing pursuant to section 5-2-205 or
consolidation pursuant to section 5-2-206 of a previous consumer credit
transaction for which a prepaid finance charge was imposed, if said refinancing or
consolidation is consummated within one year after the previous transaction, a new
prepaid finance charge may be imposed:
(a)Only on that portion of the aggregate amount financed resulting from the
refinancing or consolidation that exceeds the unpaid balance of the previ
