§ 78647.10. — 78647.10. (Added by Stats. 1996, Ch. 135, Sec. 1.)

(a)
After providing notice and an opportunity for public comment with regard to an application submitted under Section 78647.6, the board shall approve or disapprove the application, in whole or in part, not later than 120 days after the date of submission of the application. The board shall prepare, and transmit to the Resources Agency and the applicant, written findings with regard to the recommendations of the Resources Agency.
(b)
The board may approve an application if the application meets the requirements established under this article. The notice of approval shall include all of the following:
(1)
The identification of technical, financial, or other assistance that the board agrees to provide to assist in the development or implementation of a project.
(2)
Any necessary coordination that the board will perform.
(3)
A description of any funds available for the purpose of developing and implementing the project, including any funds in a water pollution control revolving fund established in connection with Subchapter VI (commencing with Section 1381) of the Clean Water Act.
(4)
A description of other technical or financial assistance that is available under state or federal law for the purpose of developing or implementing the project.
(5)
A description of activities that are undertaken, or will be undertaken, to coordinate federal and state programs which are relevant to the watershed that is the subject of the application.
(c)
If the board disapproves an application submitted under Section 78647.6, the board shall notify the entity submitting the application in writing of the reasons for disapproval. An application may be resubmitted under either of the following circumstances:
(1)
New information becomes available.
(2)
Conditions affecting the watershed that is the subject of the application change.
