UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK ABIY YIFRU, Plaintiff, 22-CV-1385 (LTS) -against- ORDER OF DISMISSAL DANIEL W. TIETZ, ET AL., Defendants. LAURA TAYLOR SWAIN, Chief United States District Judge: By order dated March 29, 2022, the Court directed Plaintiff to file an amended complaint within sixty days. That order specified that failure to comply would result in dismissal of the complaint. Plaintiff has not filed an amended complaint. Accordingly, Plaintiff’s federal claims are dismissed under 28 U.S.C. § 1915(e)(2)(B)(ii). The Court declines, under 28 U.S.C. § 1367(c)(3), to exercise supplemental jurisdiction of any state law claims. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). SO ORDERED. Dated: June 1, 2022 New York, New York
