DELA CRUZ, Chief Justice:

This is a petition seeking issuance of a writ of mandamus against the Superior Court of the Commonwealth of the Northern [5]*5Mariana Islands. Specifically, the petitioners are asking that a writ of mandamus issue against the lower court directing the latter to vacate its order entered October 19, 1989, which enjoined the Northern Mariana Islands Board of Elections from placing on the ballot for the November 4, 1989, general election a certain anti-gambling constitutional amendment initiative. It also seeks a writ directing the lower court to dismiss with prejudice the plaintiff's first amended complaint
