Opinion

Loring, J.

The appeal in this case brings to us the question of the character of the right to compensation (under the workmen’s compensation act) given to a dependent of an employee who dies of an injury within the act. In the case at bar, the death of the dependent took place while the case was pending on appeal from an award of the arbitration committee and before the case was heard by the Industrial Accident Board. An administrator intervened, and the board directed that $9.75 a week for three hundred weeks should be paid to the administrator to be paid by him to the next of kin of the deceased dependent. This was confirmed by the decree of the Superior Court.
