STATEMENT OF THE CASE

This petition arises from Petitioner Walter Demond’s convictions

for misapplication of fiduciary property, theft, and money laundering in

connection with his role as an attorney for the Pedernales Electric

Cooperative (“PEC”). 2.CR.761-66; 19.RR.4-5.2

STATEMENT OF PROCEDURAL HISTORY

The court of appeals’ opinion issued on November 21, 2014.

Demond v. State, No. 03-11-00553-CR, 2014 WL 6612510 (Tex. App.—

Austin Nov. 21, 2014, pets. filed) (Field, J., joined by Jones, C.J., and

Pemberton, J.). The court affirmed the trial court’s judgment in part,

reversed and vacated in part, and modified the conditions of Petitioner’s

community supervision. Id. at *1. Neither Petitioner nor the State

filed a motion for rehearing.

STATEMENT REGARDING ORAL ARGUMENT

The State does not believe that oral argument is necessary for any

of the issues in this case. If, however, the Court chooses to hear oral

argument, the State requests the opportunity to participate.

1. The court of appeals erred when it concluded that

Petitioner’s theft-by-deception conviction rested on legally insufficient

evidence. The court’s reasoning—that only explicit testimony indicating

that the victim organization’s board members would not have approved

of certain hires had they known of Petitioner’s and his accomplice’s
