RONALD R. COLSON, Plaintiff, 23-CV-0766 (LTS) -against- ORDER COMMISSIONER ANTHONY J. ANNUCCI, et al., Defendants. LAURA TAYLOR SWAIN, Chief United States District Judge: Plaintiff, who is currently incarcerated in Green Haven Correctional Facility, is proceeding pro se. The Court is unable to review the complaint that he submitted, however, because the ink on the original document is too light to be legible. The Court therefore directs Plaintiff to resubmit the complaint, either handwritten or typed, in a form that is legible. CONCLUSION The Court directs Plaintiff to resubmit his complaint, within 30 days of the date of this order, in a form that is legible. A prisoner civil rights complaint form is attached to this order. If Plaintiff does not resubmit the complaint, the Court will dismiss this action without prejudice to Plaintiff’s refiling it. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal. Cf. Coppedge v. United States, 369 U.S. 438, 444-45 (1962) (holding that an appellant demonstrates good faith when he seeks review of a nonfrivolous issue). Dated: March 29, 2023 New York, New York
