970.5227-10 Patent rights—management and operating contracts, nonprofit organization or small business firm contractor. As prescribed in 970.2703-2(a), insert the following clause: Patent Rights—Management and Operating Contracts, Nonprofit Organization or Small Business Firm Contractor [December 2024]

(a)Definitions—DOE licensing regulations means the Department of Energy patent licensing regulations at 10 CFR part 781. Exceptional circumstance subject invention means any subject invention in a technical field or related to a task determined by the Department of Energy to be subject to an exceptional circumstance under 35 U.S.C. 202(a)(ii) and in accordance with 37 CFR 401.3(e). Initial Patent Application means, as to a given Subject Invention, the first provisional or non-provisiona
