Text
Any person or his personal representative may maintain an action
against the personal representative of any testator or intestate
who in his lifetime has wasted, destroyed, taken or carried
away, or converted to his own use, the goods or chattels of any
person, or committed any trespass on the real estate of the
person, provided the person claiming to be damaged by the
tortious acts of the decedent files a claim for the amount of
the damages within the time limited in the notice to creditors,
and the claim is rejected.
