Text
(a)Notwithstanding any provision of this act, or any rule
of the commission adopted pursuant to the powers granted to it
by this act, the hearing on any matter or proceeding shall be
held before the commission if:
(i)The commission in its discretion desires to hear
the matter;
(ii)The application or motion so requests;
(iii)The matter is initiated on the motion of the
commission for enforcement of any rule, regulation, order, or
statutory provision;
(iv)Any party who may be affected by the matter or
proceeding files with the commission more than three (3) days
prior to the date set for the hearing on the matter or
proceeding a written objection to such matter or proceeding
being heard before an examiner; or
(v)The matter or proceeding is for the purpose of
amending, removing or addin
