Text
The department may enter into a cooperative agreement and may
contract with private attorneys to provide legal services and
legal representation necessary to assist the department in
enforcing its right to reimbursement created under article 2 of
this chapter. The department and its contract attorneys shall
have an unconditional right to intervene in any action by or on
behalf of a recipient or former recipient against any third
party who may be legally liable to reimburse any medical
assistance provided under the Wyoming Medicaid program. If no
action has been brought, the department and its contract
attorneys may initiate and prosecute an independent action on
behalf of the department against any third party that may be
liable to the person to whom the care was furnished. If the
