§ 26-34-107 — Fiduciary responsibilities
(a)Any director, officer, employee or partner of a health
maintenance organization who receives, handles, collects,
disburses or invests funds in connection with the activities of
the organization is responsible for those funds in a fiduciary
relationship to the organization and shall not violate the
prohibitions specified in W.S. 26-24-127.
(b)A health maintenance organization shall maintain in
force a fidelity bond on employees and officers in an amount not
less than the greater of two hundred fifty thousand dollars
($250,000.00), ten percent (10%) of the organization's previous
year's gross premiums or other amount the commissioner
prescribes. All such bonds shall be written with at least a one
(1)year discovery period and if written with less than a three
(3)year discovery period s
