Text
Before any bond is approved and after its approval, the officer
whose duty it is to approve the same, of his own motion or upon
the motion of any person interested in the estate, supported by
affidavit that the sureties or one (1) or more of them are not
worth as much as they have justified to, may order the sureties
to appear before him at a designated time and place to be
examined touching their property and its value. The officer
shall, at the same time, cause a notice to be issued to the
personal representative requiring his appearance at the
examination. If, upon examination of the sureties and the
witnesses who appear, the officer is satisfied that the bond is
insufficient, he shall require additional security.
