Text
When real estate taken on execution is appraised and is twice
advertised and offered for sale but remains unsold for lack of
bidders, the court from which the execution issued on motion of
the plaintiff or defendant shall set aside the appraisement and
order a new appraisement to be made, or set aside the levy and
appraisement and award a new execution to issue. When the real
estate or any part thereof has been three (3) times appraised
and thereafter twice advertised and offered for sale, and
remains unsold for lack of bidders, the court may direct the
amount for which the property shall be sold.
