Text
When an officer levies execution in good faith, upon property
not subject thereto, sells the property and applies the proceeds
in satisfaction of the judgment, and a recovery is had against
him for its value, upon payment of the recovery and on motion
and notice to the execution defendant in the court having
control of the judgment, the officer may have the satisfaction
of the judgment vacated and execution issued for his use the
same as if the levy and sale had not been made.
