Text

(a)Any unlawful firearm in the possession of an agency that is not needed as evidence for or in a criminal prosecution or other judicial or administrative proceeding shall, within 30 days of its receipt by the agency, be delivered to such place and in such manner as the Commissioner of Public Safety designates for ultimate disposition in accordance with the provisions of this chapter.
(b)Any unlawful firearm in the possession of an agency needed as evidence for or in a criminal prosecution or other judicial or administrative proceeding may be retained by the agency for such purposes and until the conclusion of such prosecution or proceeding.
