On request, the fence viewers, or a majority of them, shall examine fences within the town and a division shall be made by them in cases proper for them to determine. If a fence viewer neglects to perform the duties required of him or her, he or she shall forfeit to the party aggrieved $5.00, with costs to be recovered in a civil action on this statute. Either party may appeal from the decision of the fence viewers to a Superior Court if such appeal is claimed within two hours from the rendition of the decision. Such appeal shall be taken as provided by Rule 75 of the Vermont Rules of Civil Procedure. (Amended 1965, No. 194, § 10, operative Feb. 1, 1967; 1973, No. 193 (Adj. Sess.), § 3, eff. April 9, 1974.)
