§ 79-9-104 — Outdoor recreation mitigation board.

(1)There is created the Outdoor Recreation Mitigation Board consisting of the following five members:

(1)(a) two representatives of the Utah Association of Counties, appointed by the Utah Association of Counties;

(1)(b) one representative of the Utah Sheriffs' Association, appointed by the Utah Sheriffs' Association;

(1)(c) one representative of rural emergency medical services directors, appointed by the director of the division after consultation with an organization representing rural emergency medical services directors; and

(1)(d) an individual representing the tourism industry, appointed by the director of the division after consultation with an organization representing the tourism industry.

(2)The board shall annually select one of the board's members to be the chair of the board

(1) There is created the Outdoor Recreation Mitigation Board consisting of the following five members:
(1)(a) two representatives of the Utah Association of Counties, appointed by the Utah Association of Counties;
(1)(b) one representative of the Utah Sheriffs' Association, appointed by the Utah Sheriffs' Association;
(1)(c) one representative of rural emergency medical services directors, appointed by the director of the division after consultation with an organization representing rural emergency medical services directors; and
(1)(d) an individual representing the tourism industry, appointed by the director of the division after consultation with an organization representing the tourism industry.
(2) The board shall annually select one of the board's members to be the chair of the board.
(3) (3)(a) If a vacancy occurs in the membership of the board, the member shall be replaced in the same manner in which the original appointment was made.
(3)(b) A member of the board shall serve a term of four years and until the member's successor is appointed and qualified.
(3)(c) Notwithstanding Subsection (3)(b), the initial appointment of one member described in Subsection (1)(b) and one member described in Subsection (1)(c) shall be two years so the terms of board members are staggered and approximately half of the board members are appointed every two years.
(3)(d) An individual may be appointed to more than one term.
(3)(e) Three board members constitutes a quorum.
(3)(f) The action of a majority of a quorum constitutes action of the board.
(4) A board member may not receive compensation or benefits for the member's service on the board, but may receive per diem and reimbursement for travel expenses incurred as a board member at the rates established by the Division of Finance under:
(4)(a) Sections 63A-3-106 and 63A-3-107; and
(4)(b) rules made by the Division of Finance pursuant to Sections 63A-3-106 and 63A-3-107.
(5) The division shall provide staff support to the board.
