(1)(1)(a) As used in this section, "conspicuously printed" means printed in either larger or bolder type size than the adjacent and surrounding material so as to be clearly legible to an individual viewing the print.
(1)(b) Terms defined in Sections 76-1-101.5 and 76-9-1401 apply to this section.
(2)An actor commits advertising or soliciting participation in a lottery if the actor distributes or disseminates an advertisement or other written or printed material containing an advertisement or solicitation for participation in a lottery.
(3)(3)(a) Except as provided in Subsection (3)(b), a violation of Subsection (2) is subject to a fine of $2,500.
(3)(b) A violation of Subsection (2) is subject to a fine of $10,000 if the actor has previously been convicted of a violation of Subsection (
