§ 76-9-1116 — Unlawful sale of a tobacco product, electronic cigarette product, or nicotine product.

(1)(1)(a) As used in this section:
(1)(a)(i) "Compensatory service" means service or unpaid work performed by an employee, in lieu of the payment of a fine or imprisonment.
(1)(a)(ii) "Employee" means an employee or an owner of a tobacco retailer.
(1)(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.
(2)An actor commits unlawful sale of a tobacco product, electronic cigarette product, or nicotine product if the actor:
(2)(a) is an employee; and
(2)(b) intentionally or knowingly sells or gives a tobacco product, an electronic cigarette product, or a nicotine product in the course of business to an individual younger than 21 years old.
(3)A violation of Subsection (2) is:
(3)(a) on a first violation:
(3)(a)(i) an infraction; and
(3)(a)(ii) subject to:
(3)(a)(ii)
