(1)(1)(a) As used in this section, "clove cigarette" means a cigarette that contains more than 10%, by weight, of raw eugenia caryophyllata or caryophyllus, commonly known as clove.
(1)(b) Terms defined in Sections 76-1-101.5 and 76-9-1101 apply to this section.
(2)An actor commits illegal sale or gift of clove cigarette if the actor knowingly sells, offers for sale, gives, or furnishes a clove cigarette in this state.
(3)A violation of Subsection (2) is a class B misdemeanor.
