§ 76-9-1101 — Definitions.

As used in this part:

(1)(1)(a) "Alternative nicotine product" means a product, other than a cigarette, a counterfeit cigarette, an electronic cigarette product, a nontherapeutic nicotine product, or a tobacco product, that:
(1)(a)(i) contains nicotine;
(1)(a)(ii) is intended for human consumption;
(1)(a)(iii) is not purchased with a prescription from a licensed physician; and
(1)(a)(iv) is not approved by the United States Food and Drug Administration as nicotine replacement therapy.
(1)(b) "Alternative nicotine product" includes:
(1)(b)(i) pure nicotine;
(1)(b)(ii) snortable nicotine;
(1)(b)(iii) dissolvable salts, orbs, pellets, sticks, or strips; and
(1)(b)(iv) nicotine-laced food and beverage.
(1)(c) "Alternative nicotine product" does not include a fruit, a vegetable, or a tea that
