Text
(1)Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.
(2)An actor commits wrongful commencement of an action in justice court if the actor:
(2)(a) is:
(2)(a)(i) a party to a suit or a proceeding; or
(2)(a)(ii) an agent or attorney for a party to a suit or proceeding; and
(2)(b) except as provided in Section 78A-7-105 or 78A-7-106, knowingly commences, prosecutes, or maintains an action, suit, or proceeding in a justice court.
(3)A violation of Subsection (2) is a class B misdemeanor.
