(1)(1)(a) As used in this section, "employing unit" means the same as that term is defined in Section 35A-4-202.
(1)(b) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.
(2)An actor commits unlawful use or disclosure of employment information if the actor:
(2)(a) (2)(a)(i) is an employee of the Department of Workforce Services; and
(2)(a)(ii) willfully violates Section 35A-4-312 by making a disclosure of information obtained from an employing unit or individual in the administration of Title 35A, Chapter 4, Employment Security Act; or
(2)(b) (2)(b)(i) obtains a list of applicants for work or of claimants or recipients of benefits under Title 35A, Chapter 4, Employment Security Act; and
(2)(b)(ii) uses or permits the use of the list described in Subsection (2)(b)(i)
