Text

(1)(1)(a) As used in this section:
(1)(a)(i) "Child" means an individual younger than 14 years old.
(1)(a)(ii) "Common area of a privacy space" means the same as that term is defined in Section 76-5-419.
(1)(a)(iii) "In the presence of" includes within visual contact through an electronic device.
(1)(a)(iv) "Privacy space" means the same as that term is defined in Section 76-12-309.
(1)(a)(v) "Sex-designated" means the same as that term is defined in Section 76-12-309.
(1)(b) Terms defined in Section 76-1-101.5 apply to this section.
(2)An actor commits lewdness involving a child if:
(2)(a) the actor, under circumstances not amounting to an offense listed in Subsection (4), intentionally or knowingly does any of the following in the presence of a child:
(2)(a)(i) performs an act of sexu
