(1)(1)(a) As used in this section, "minor" means an individual who is 14 years old or older but younger than 18 years old.

(1)(b) Terms defined in Section 76-1-101.5 apply to this section.

(2)An actor commits unlawful kissing of a minor if the actor:

(2)(a) intentionally or knowingly:

(2)(a)(i) kisses a minor on the minor's mouth; and

(2)(a)(ii) penetrates the minor's mouth with the actor's tongue; and

(2)(b) is older than the minor by 10 years or more.

(3)A violation of Subsection (2) is a class A misdemeanor.

(4)Any penetration, however slight, of the mouth of the minor by the actor's tongue is sufficient to constitute a violation of this section.
