§ 76-5-207 — Automobile homicide -- Penalties -- Evidence.

(1)(1)(a) As used in this section:
(1)(a)(i) "Controlled substance" means the same as that term is defined in Section 58-37-2.
(1)(a)(ii) "Criminally negligent" means the same as that term is described in Subsection 76-2-103(4).
(1)(a)(iii) "Drug" means:
(1)(a)(iii)(A) a controlled substance;
(1)(a)(iii)(B) a drug as defined in Section 58-37-2; or
(1)(a)(iii)(C) a substance that, when knowingly, intentionally, or recklessly taken into the human body, can impair the ability of an individual to safely operate a vehicle.
(1)(a)(iv) "Negligent" or "negligence" means simple negligence, the failure to exercise that degree of care that reasonable and prudent persons exercise under like or similar circumstances.
(1)(a)(v) "Vehicle" means the same as that term is defined in Section 41-6a-501.
