Text

(1)Terms defined in Sections 76-1-101.5, 76-12-101, and 76-12-401 apply to this section.
(2)An actor commits unlawful use of a person's name as a solicitation endorsement if, without written consent:
(2)(a) the actor uses the name of a person on any stationery, advertisement, brochure, or correspondence of a charitable organization for the purpose of soliciting contributions; or
(2)(b) the actor lists or refers to the person's name as a person who has contributed to, sponsored, or endorsed the charitable organization or the charitable organization's activities.
(3)A violation of Subsection (2) is an infraction.
