Text

(1)Beginning January 1, 2026, all prosecutorial agencies within the state shall collect and submit the following data to the commission:
(1)(a) the number of prosecutions during the previous calendar year in which charges were brought against an individual based on the individual's false accusation that a felony or misdemeanor had occurred;
(1)(b) the disposition of each prosecution described in Subsection (1)(a); and
(1)(c) the number of cases during the previous calendar year for which an alleged violation of any felony or misdemeanor was dismissed or declined:
(1)(c)(i) based on evidence that no crime was committed or attempted;
(1)(c)(ii) based on insufficient evidence to establish a likelihood of success at trial; or
(1)(c)(iii) because the victim was unable to participate.
