Text

(1)An interlocal entity is:
(1)(a) separate from the public agencies that create it;
(1)(b) a body politic and corporate; and
(1)(c) a political subdivision of the state.
(2)(2)(a) Any two or more Utah public agencies may enter into an agreement to approve the creation of a Utah interlocal entity to accomplish the purpose of their joint or cooperative action, including undertaking and financing a facility or improvement to provide the service contemplated by that agreement.
(2)(b) The creation, operation, governance, and fiscal procedures of an interlocal entity and its governing authority are governed by this chapter and are not subject to the statutes applicable to its members or other entities.
