§ 10-2a-201.5 — Qualifications for incorporation.

(1)(1)(a) An area may incorporate as a town in accordance with this part if the area:
(1)(a)(i) (1)(a)(i)(A) is contiguous; or
(1)(a)(i)(B) is a community council area;
(1)(a)(ii) has a population of at least 75 people, but fewer than 1,000 people; and
(1)(a)(iii) is not already part of a municipality.
(1)(b) A preliminary municipality may transition to, and incorporate as, a town, in accordance with Section 10-2a-510.
(1)(c) An area may incorporate as a city in accordance with this part if the area:
(1)(c)(i) (1)(c)(i)(A) is contiguous; or
(1)(c)(i)(B) is a community council area;
(1)(c)(ii) has a population of 1,000 people or more; and
(1)(c)(iii) is not already part of a municipality.
(2)(2)(a) An area may not incorporate under this part if:
(2)(a)(i) the area has a population of fewe
